Terms and Conditions

Rates and Conditions

All rates quoted are in Australian Dollars.

Rates and conditions quoted may change without notice. Once a booking has been confirmed by Suncamper the rates and conditions will not change, notwithstanding changes in legislation and errors.


Definitions

"This agreement" means the rental agreement and its terms and conditions.

"Customer" means the person(s) nominated as the hirer and any person whose credit card is presented for the customer's charges.

"Suncamper" is a subsidiary of M.W. George Pty Ltd.

"Rental period" means any time the vehicle is in the customer's possession or control and the hire period or any agreed variation.

"Vehicle" means the vehicle hired by the customer and includes tyres, tools, accessories, camping utensils, all other equipment, documents or additional hire items related to the Vehicle and any replacement or substitute Vehicle that may be provided.


Rental Duration

Rental days are calculated on a calendar basis. The day of pickup is counted when calculating the number of days the Vehicle is rented, regardless of pick-up time. The day the Vehicle is returned is counted as the final day of the rental, regardless of drop-off time.

Minimum rental period is seven days with a minimum period of 14 days for one-way rentals. Minimum rental periods are subject to change without notice. Any changes will be notified prior to booking confirmation.

Late pick-up or early drop-off of a Vehicle does not entitle the Customer to any refund or discount for the unused portion.


Delivery and Return of Vehicles

The Customer must acknowledge that the Vehicle has a full tank of petrol and gas (when applicable) and is in a neat and clean condition. The customer must return the vehicle with a full tank of petrol and gas, when applicable, and in a neat and clean condition on the return date, time and location as set out in the Rental Agreement.

The customer acknowledges that Suncamper reasonably determine what, if any, refund may be warranted if the vehicle is returned prior to the return date or the Customer ceases to have use of the Vehicle.


Branch Hours

Branches are open Monday to Friday, 9:00 am until 5:00 pm, in the respective time zone. Branches are closed on Public Holidays in that zone.


Drop-off Destination

If the customer wishes to change the drop-off destination after the rental has commenced, they must first obtain authorisation from Suncamper in writing. Subject to approval, an additional charge of up to $500 may apply. This will be notified at time of approval. This fee may apply in all cases, irrespective of the reason(s) for location change. One-way rentals to Tasmania must be confirmed before the rental period commences.


Late Drop-offs

If the customer wishes to drop-off the Vehicle after business hours, they must first get approval from the destination branch. Subject to approval, a fee of $150 is applicable and the Customer will be required to pay an extra full day of rental, not including the discounted rates. The Vehicle will be the Customer's responsibility up until it has been checked by a Suncamper staff member.


Rental Extension

If the Customer wishes to extend the rental period after the rental period has commenced, they must first obtain authorisation from Suncamper. This is subject to availability. The extra cost of the rental extension must be paid via credit card on confirmation of the rental extension. Failure to obtain authorisation for a rental extension will result in a late fee of $150 per day in addition to the daily rental rate for each day, without discounts, until the Vehicle is returned. The daily rental rate charged will be based on Suncamper's current, standard rental rates per vehicle for the rental period.


Airport Travelling Fees

An airport travelling fee applies for Customers who are picked-up or dropped-off from airport locations. This fee is subject to change and is varied between airports. Details of charges can be obtained upon booking or from the Customer Service Representative upon pick-up.


One-way Rentals

One-way rentals are available from all branch locations. One-way rentals to Tasmania are not permitted and severe penalties will apply. One-way rental fees are subject to change, depending on location. The amount can be obtained upon booking or from the Customer Service Representative upon pick-up.


Multiple Rentals

Should a driver require more than one Vehicle, the rental periods can be combined to receive a discount for longer term hires. If two hires are made within a three month period, their rental periods can be combined to receive a longer term discount also.


Extra Driver

A fee of $3 per day of rental will apply for every additional driver, with a maximum charge of $150 per additional driver.


Licence Requirements

A full, non-probationary, resident country, car driver's licence must be held by all drivers for a minimum of one year prior to the hire of a Vehicle. If the licence is not in English, an international driver's licence is also required.


Age Restrictions

Drivers must be between the ages of 25 and 75 years. Drivers outside of this age bracket may hire a Vehicle, completely, at the discretion of the manager and must be in writing. The driver will also be subject to additional insurance and other charges. Drivers outside of this age bracket will also have to provide additional information if required.


Use of the Vehicle

The Customer agrees that, during the rental period, the Customer will not allow the vehicle to be:

  1. driven otherwise than in a cautious, sensible and normal manner.
  2. driven by a person who has consumed alcohol within 24 hours prior. Or a person who is under the influence of drugs.
  3. left with the ignition key in the Vehicle while it is unoccupied.
  4. damaged by:
    1. submersion in water.
    2. contact with salt water.
    3. creek or river crossing.
    4. driving through low-plain, flooded areas.
    5. beach driving.
    6. used for any illegal purpose or in any race, rally or contest.
    7. used to tow any vehicle or trailer.
    8. used to carry passengers or property for hire or reward.
    9. used to carry more persons than is permitted by the relevant law or authority, or detailed in the Vehicle Manual or on the Vehicle or specified in this agreement.
    10. used to carry any volatile liquids, gases, explosives or other corrosive materials.

Road restrictions apply as follows:

  1. Vehicles must not be used on any unsealed road (being a road that is not sealed with a hard material such as tar, bitumen or concrete. Off-road conditions include, but are not limited to, fire-trails, beaches, sand, tracks, fields or paddocks. The only exception to this is reasonable use of access roads to recognised, commercial campgrounds.
  2. Suncamper reserves the right to restrict vehicle movements in certain areas due to weather conditions, road conditions and the nominated distance to destinations in relation to the length of hire period.

The customer may not make alterations or additions to the Vehicle without prior written authorisation.

The customer will not allow any animals to enter the vehicle, with the exception of registered guide dogs.

The Customer shall take all reasonable steps to properly maintain the Vehicle, including periodic checks of oil, batteries and water, as in the Vehicle Manual and will notify Suncamper immediately should vehicle warning lights indicate any potential malfunction.


Maintenance and Repairs

Suncamper will reimburse customers for expenditure up to $100, reasonably incurred in rectifying any mechanical failure to the drive train and engine of the Vehicle.

For repairs in excess of $100, Suncamper will need to be informed and confirm the repair in advance.

In all cases, the Customer must be able to present receipts to receive reimbursement and must not be responsible for the damage.

The customer will be responsible for any cost associated with the incorrect use or contamination of fuel or water.

Subject to the terms of the Insurance Agreement, customers will be responsible for, and pay for the cost of, replacing or repairing tyres, damaged during the rental period, except if the tyre is defective and is returned by the Customer to Suncamper for inspection and is subject to a warranty claim by the manufacturer.

The customer will pay the Suncamper daily rental rate for the period the vehicle is off fleet for accident repairs.


On Road Assistance

Any problems associated with the Vehicle, including equipment failure, must be reported to Suncamper by the next working day in order to give Suncamper the opportunity to rectify the problem during the rental period. Failure to do so may compromise any claims for compensation. Suncamper reserves the right to not accept liability for any claims submitted after this period.


Vehicle Availability

Vehicles can be requested by category only, not by make or model.

Suncamper will endeavour to supply the vehicle category selected, however, should the vehicle booked be unavailable through unforeseen circumstances Suncamper reserves the right to substitute an alternative vehicle without prior notification. The alternative vehicle shall be as close a substitute to the booked vehicle as possible. Suncamper will determine what, if any, refund may be warranted if a vehicle substitution is required.

Should the Customer decide to take a lesser vehicle than booked they will not be entitled to any refund.


Title of Vehicle

The Customer acknowledges that Suncamper retains the title to the Vehicle at all times. The Customer shall not agree, attempt, offer or purport to sell, assign, sub-let, lend, pledge, mortgage, let on hire or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle.


Personal Protection

Personal Injury is covered, in most cases, by registration or Third Party Insurance. However, we strongly recommend that all people travelling in Australia take out Personal Travel Insurance. Suncamper does not accept any liability for personal injuries sustained during rental.


Excess Reduction Options

The Customer understands that:

  1. The Vehicle is insured for third party property and Vehicle damage.
  2. The Customer will have to pay an excess in respect of any damage incurred whilst in the customers possession.
  3. The excess will be reduced by taking out one of the Excess Reduction Options.

Any Excess Reduction is void, and the Customer will be responsible for the total cost of any damage if the Customer breaches any of the conditions of "Use of the Vehicle". If no Excess Reduction Option is taken, the Customer is responsible for the first $5,000 of the cost of damage.

With the Reduction Protection Package the hirer is responsible for the first $2,500.

With the Premium Protection Package the hirer is responsible for the first $450.

The excess applies in respect of each claim, not per rental.

The excess is applicable regardless of who is at fault and must be paid at the time the accident is reported, not on the completion of rental. The excess will be refunded only if Suncamper are successful in recovering the cost of the damages from the third party. Some third party claims can take months or even years to resolve.

Damage includes:

  1. Any and all damage to third party property.
  2. Damage to the rented Vehicle including:
    • windscreens.
    • tyres.
    • towing and recovery costs.
    • theft.
    • fire.
    • break in.
    • vandalism.
  3. This also includes the cost of the daily rental rate for the period the vehicle is off fleet for repair.

Exclusions

The Customer acknowledges that they are responsible for all costs for the following damage irrespective of Excess Reduction Options that may have been taken. Damage as identified below is specifically excluded from any Excess Reduction Option limitation of liability and the Customer remains fully liable for all costs incurred:

  1. Any damage due to the Vehicle in contravention to "Use of the Vehicle".
  2. Any damage caused by wilful misconduct. This does include:
    • driving under the influence of drugs or alcohol.
    • sitting or standing on the vehicle bonnet.
    • negligence.
  3. Any loss or damage to personal belongings
  4. If the Customer is proven o have not abided by the road rules, resulting in damage to the vehicle or third party vehicle or property
  5. The cost to retrieve or recover a vehicle that has become bogged
  6. The cost to replace keys which have become lost, stolen, or retrieval of keys that have been locked in the vehicle
  7. Any damage caused to the overhead (above the cab) or under body damage however caused

Vehicle Security Deposits

On pick-up of the Vehicle, the Customer agrees to pay a vehicle security deposit. The Customer authorises Suncamper to deduct from the Security Deposit any amounts due by them to Suncamper arising out of the agreement. The Vehicle Security Deposit amount is determined by the Excess Reduction Option selected.

If the Customer does not select the Reduction Protection Package or Premium Protection Package the Security Deposit is $5,000 payable by cash or credit card. If the Security Deposit is payed by credit card, the amount will be debited immediately.

The Security Deposit is fully refundable provided the Vehicle:

  1. is returned on time
  2. has a full tank of fuel
  3. is returned to the correct location
  4. includes all original equipment
  5. undamaged
  6. has a clean interior
  7. has not been involved in an accident

Suncamper reserves the right to retain a $125 soiling fee if the vehicle is not returned with the interior in clean condition and free of mud. The toilet and waste water tank, if applicable, must be emptied prior to the return of the Vehicle, or an additional $125 soiling fee will be retained.

Failure to return the vehicle with a full tank of fuel will result in a charge for refilling.

If items are missing from the equipment list of the vehicle a fee will be charged as per the cost of the missing item(s).


Accident Procedure

If the Customer is involved in a motor vehicle accident whilst on hire, at the scene of the accident, the Customer must:

  1. Obtain the names and addresses of all third parties and any witnesses
  2. Not accept blame or insist the other party is at fault
  3. If possible, photograph damage to the vehicles or property involved.
  4. Phone Suncamper's head office by the end of the next working day.

At the branch:

  1. The Customer must produce their Driver's Licence and hand over the Police Report, if applicable and any supporting photographs.
  2. The Customer is required to pay the excess and any other amount due by them in respect of any damage arising from an accident, loss or damage.
  3. The Suncamper representative will ensure the Motor Vehicle Accident Report is completed clearly and accurately signed by the Customer.

The availability of an exchange vehicle is not guaranteed. It is subject to availability, client location, accident liability and the remaining rental duration. If an exchange Vehicle is required as a result of an accident, the Customer is responsible for making their own way to the nearest Suncamper branch or pick-up location at their own cost. Suncamper may offer the customer the option of paying an "Exchange Vehicle Relocation Fee" to send a driver to deliver the exchange vehicle to the Customer's location. The Customer will pay for any costs relating to delivery of a change over vehicle as a result of any single vehicle accident. This charge applies irregardless of any excess reduction taken.


Settlement of Customer Excess Claims

Suncamper will use best endeavours to ensure that any money due back to client is forwarded as quickly as possible, however third party claims can take months or even years to resolve. Suncamper cannot force the destiny of these claims, and the Customer acknowledges that handling of these claims is up to Suncamper's insurer and the third party, whether they are insured or not. Suncamper agrees to refund any Excess refunds applicable within 60 days of receiving final resolution and payment relating to third party claims. The Customer agrees to provide all reasonable assistance to Suncamper in handling any claims including providing all relevant information and attending court to give evidence.

Under no circumstances should a Customer attempt to start or drive a Vehicle that has been involved in an accident, damaged by a roll-over, water submersion or any other means without permission from Suncamper. If the Vehicle in un-drivable after an accident and the Customer would like to have a replacement vehicle (subject to time, distance and availability)the Customer must make their own way, at the Customer's expense, to the nearest Suncamper branch. In the event that the Vehicle is considered a write-off, the Excess Reduction Option will terminate. Should the Customer require a new Vehicle, a new Excess Reduction Option will be required.


Release and Indemnity

The Customer releases Suncamper, employees and agents, from any liability to the Customer (regardless of who is at fault), for any loss or damage incurred by the Customer by reason of rental, possession or use of the Vehicle.

The Customer hereby indemnifies and shall keep indemnified Suncamper, its employees and agents, against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of the Customer's use and/or possession of the Vehicle.

Any indemnity required of the Customer shall not operate to indemnify Suncamper in respect of any negligent act by Suncamper.

Nothing contained in these terms and conditions shall exclude any express or implied conditions, warranties or requirements that cannot be so excluded under the Trade Practices Act or any other corresponding State legislation that may be applicable.


Infringements

Suncamper reserves the right to charge the Customer for any speeding, parking, tollway or other fines, associated administration costs and/or accidents including third party property damage not reported on return of the Vehicle. The administration fee per incident will be $60.


Rental Charges

Total charges as set out in your Rental Agreement are not final. The Customer will pay any shortfall in charges to Suncamper and the Customer will receive a refund for any overcharges made by Suncamper. Wherever possible, any amendment to charges will be notified to the Customer at conclusion of rental, and the Customer agrees to payment of any such charges at that time.


Taxes

A surcharge of 2% of the total cost of all hire is applicable to cover state government taxes and associated costs. This charge is payable on collection of the Vehicle.


Payment of Charges

All charges and expenses payable by the Customer and this Agreement are due on demand by Suncamper, including any collection costs and reasonable legal fees incurred by Suncamper.

When the Customer comprises of more than one person, each person is liable jointly and severally for all obligations of the Customer pursuant to this agreement.


Credit Card Payments

If a credit card is presented as payment, the credit card holder will be jointly and severally liable as the Customer.

The following credit cards are accepted: Visa, MasterCard, Bankcard and American Express. A surcharge of 3% applies to use Visa, MasterCard and Bankcard for payment and security bond purposes. A surcharge of 5% applies to use American Express for payment and security bond purposes.

When payment is made by credit card the Customer agrees that:

  1. Suncamper is irrevocably authorised to complete any documentation and to take any other action to recover from the Customer's credit card issuer all amounts due by the Customer pursuant to this Agreement, including, but not limited to, any amounts due in respect of damage to the Vehicle or property of a third party and all other additional charges as they are incurred including all parking and traffic infringement penalties, tollway fines and associated administration costs.
  2. The Customer will not dispute their liability to Suncamper for any amount properly due under this agreement and the Customer shall indemnify and keep indemnified Suncamper against any loss incurred, including legal costs, by reason of notifying the Customer's credit card issuer of such dispute.
  3. In the event that Suncamper elect to accept payment of the security deposit by holding a signed and authorised open credit card voucher which is returned to the Customer at the completion of the rental period, the Customer agrees that Suncamper is entitled to recover payment from the Customer's credit card issuer pursuant to paragraph (a) in respect of any amounts due which were not known at the time of return of the voucher
  4. Suncamper may process credit card charges pertaining to the rental after the hire period.

The Customer acknowledges that all transactions under this agreement are conducted in Australian Dollars. Due to exchange rate fluctuations, there could be some variance between the amount initially debited against the Customer's credit card and the amount refunded. Suncamper accepts no liability for any such variations.


Personal and Company Cheques

Personal and Company cheques will not be accepted as payment for rentals at the time of pick-up. Personal and company cheques will not be accepted as the vehicle security deposit.


Conditional upon Payment

The Customer agrees that provision of any rental vehicle is conditional upon Suncamper being paid prior to travel commencing by the Travel Agent or Travel Wholesaler who arranged the vehicle rental on the Customer's behalf.


Terminating the Agreement and Repossessing the Vehicles

The Customer acknowledges that Suncamper may terminate this agreement and repossess the Vehicle, and for that purpose enter upon any premises and remove the Vehicle, at any time, without notification to the Customer, and that Customer will pay the reasonable costs of repossessing the Vehicle, including towing charges if:

  1. The Customer is in breach of any material term of this agreement.
  2. The Customer has obtained the Vehicle through fraud or misrepresentation.
  3. The Vehicle appears to be abandoned
  4. The Vehicle is not returned on the agreed return date or Suncamper reasonably believes that the Vehicle will not be returned on the agreed return date
  5. Suncamper considers on reasonable grounds that the safety of the passengers or the condition of the Vehicle is endangered.

The Customer understands that in the event of such termination or repossession, the Customer has no right to a refund of any part of the rental charges or the Security Deposit.


Cancellations

If a rental is cancelled within 30 to 60 days prior to pick-up, a 20% charge of total rental costs applies. If a rental is cancelled within 7 to 29 days prior to pick-up, a 50% charge of total rental applies. If a rental is cancelled within 6 days of pick-up or a no-show occurs, 100% of the total rental cost will be charged.


Amendments

An amendment fee of $50 per amendment is payable when a change to an existing booking is made within 14 days of pick-up date. This includes change of name, vehicle type, reducing rental duration, change of pick-up dates and pick-up or drop-off location.


Warranties

The Customer warrants that all information supplied to them by Suncamper is connection with this Agreement is true.


Entire Agreement

This agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between parties relating to the subject matter of this Agreement.
